A quick search makes it clear that Trump had nothing to do with the decision.

The US military was simply were unable to hold them based on current legal doctrine.
There is also no legal doctrine that supports blowing people out of the water without actual evidence...but they did it anyway. And had to let the survivors go.

That's true, it's not legal to blow people out of the water. However it's irrelevant is that doesn't change the laws as they pertain to how the perpetrators were dealt with in this instance.

Edited to add: No different than when a drunk driver wipes out an innocent mother and a kid who were out for a walk, they're dead or crippled and the drunk driver gets jailed for 30 days.

Life aint fair, but complaining about it won't change anything. At least, not for a very long time and even then probably not by much if at all.
