He could have increased the number of judges, by executive order, I believe. The Constitution does not stipulate how many judges sit on the court, and the number has been changed over the centuries. The stacking of the court was talked about a lot when he first took office, especially considering what the CONs did to Merrick Garland. He shouldn't have stood for that.
