A discussion on if a shooting is self defense or not?

I don't know the law in Ohio so that is a really import part unknown but can each of you watch this video and then tell me if you think this was self defense or not?

I see where prowler is coming from in that technically the onslaught had stopped. but what I'm also seeing is a very aggressive opponent who can still be a significant threat and is still acting out instead of leaving

If I were on the jury I'd be voting full acquittal

Once the person's back is turned and they are walking away.....you have to let them. If the psycho was still coming towards her, it would have been.

That was just anger and revenge. That's definately NOT self defense. You gotta give that person a chance to chose the bullet. She could have just brandished and told the woman to leave.

Stand your ground just means you don't have a duty to retreat, but it wouldn't apply here as the clerk was advancing towards, and shot at, a person who was no longer a threat. The law doesn't care if you got your ass kicked yesterday, five minutes ago, or five seconds ago... The only important thing is what's happening at the exact moment the trigger is pulled.

Some States may recognize what's called 'imperfect self defense', but this is rare. And it doesn't absolve one of charges, it simply may reduce jail time.

The Jose Alba case in NYC seems a clear cut case of self defense and like the Rittenhouse case the whole thing was caught on tape. Also like the Rittenhouse case a degenerate democrat prosecutor is going after him for ideological reasons.

He has charged, to the max, an elderly immigrant who did everything possible to avoid and escape from the violent felon who was assaulting him. It is clear the radical left just wants black criminals to be above the law and no matter what crimes they commit no consequences should ever happen to them.

I'm genuinely convinced most of them are just sociopaths who really dont care what happens to people as long as they get their way politically.

I remember this incident.

I'll throw a couple of ideas out there.

1) If possible the Feds take over the case, and apply the law as it should be applied.

2) That very far left leaning district attorney can be removed from his position because
he is in violation of his Oath Of Office.

Here in Los Angeles county we have the same problem,.........
He is is District Attorney George Gascón.
He has an ongoing fight with the assistant district attorneys that work under him.
I can't type out all the problems he has brought about.

Very anti victim,..... I just can't understand it, I'm talking about mothers who had their sons murdered,......
not allowing them to have the support of a representative from the DA's office at parole hearings.
Our sheriff's department stepped up to stand with victims during these hearings.
And their department caught static for doing it.

In one case, the murder of an off duty police officer, while he and his fiancé were house shopping,
George Gascón was going to go light on the group of no goods that were caught and arrested.
The Feds swooped in and took the case.
But, the Feds were able to do that because the crime was in the furtherance of gang profits.
Falls under the RICO statute.

This George Gascón was also supported and financed by George Soros.

The public of L.A. County mounted a recall effort but it fell shy because of errors in the ballot signatures.

Next door, in Orange County the District Attorneys are firm but fair.
Can't ask for more than that.
