on the one hand they are tying to claim putting one's hands up indicates no threat (as in the case with GrossKurtz) but now their latest witness completely contradicts this stance by indicating clearly that putting ones hands up does not mean a sudden absence of threat on the part of that individual.
look at the line of questioning on this officer starting at 52:40 which completely decimates their prior argument on GrossKutz putting his hands up therefore kyle should not have felt threatened
